Refugees

Refugees are individuals who have escaped bloodshed, attacks, struggle or ill treatment and have crossed an international border to find refugee in another nation. Refugees or Asylum Seekers are protected by international law.

Foreign nationals, who fear persecution, are at serious risk of harm, and cannot find refugee in their own country often seek refuge in Canada. People who are recognized as refugees are allowed to stay in Canada and may apply for permanent residence status, and eventually may apply to become Canadian citizens.

An Individual in Need of Shelter is a person in Canada who, if sent back to their home country or country where they normally reside, would face suffering and pain and a threat to their life.

In danger of harsh and bizarre treatment or abuse if they do not get security from their own country's government.

The fear of ill treatment must be well-founded and based on their race, religion, nationality, political opinion, or their membership in a particular social group.

A national is individually and personally affected by civil war, armed battles, or a violation of basic human rights.

Eligibility Requirements

The Refugee Protection Division of the Immigration and Refugee Board (IRB) is an independent tribunal that will make a determination as to whether the applicant will receive refugee status. In some cases, such as those involving criminality or security issues, the decision is made by Immigration, Refugees and Citizenship Canada (IRCC).
